Family Law and Litigation

We provide LIMITED family law services and do not practice District Court procedure, to include but not limited to maintenance, access, guardianship and domestic violence matters.
We do divorces and separation agreements on consent only, usually following on from attendance at mediation.
We can of course provide general advices and do co-habitation agreements in relation to property matters.

Following mediation ABC Solicitors will advise and draft a Deed of Separation which is a legally binding written contract. The main issues dealt with in a separation agreement are:
  • An agreement to live apart
  • Agreed arrangements in relation to custody and access to children
  • The occupation and ownership of the family/shared home and any other property
  • Maintenance and any lump sum payments
  • Indemnity from the debts of the other spouse/civil partner
  • Taxation

Wills, Probate and Estates

Probate is the area of law dealing with the estate of a person who has died. When a loved one passes away we will provide you with expert advice on all areas of Probate law and we will assist you, the personal representatives, executors and administrators by guiding them in administering a deceased’s estate in a timely and efficient manner.

The identity of the personal representative will depend on whether the deceased left a will and named an executor in it. If not, there are rules which govern who is entitled to act as the personal representative. We can also advise you on the rights of a spouse to a legal right share, a co-habitant or a child to an inheritance from a parent.




The Succession Act 1965 is the main piece of legislation governing Probate matters in Ireland.
When someone passes away their estate or assets pass to their personal representative. In order for the next-of-kin or beneficiaries to receive their inheritance the deceased’s estate needs to be ‘administered’ through the Probate Office of the High Court by the personal representative. ABC Solicitors will help you through the legal requirements so that matters are dealt with and sorted out as per the deceased’s wishes.

Audrey Byrne,
B. Corp Law, LLB

Audrey is the sole practitioner in our general practice. With a degree in Corporate Law and an LLB from NUI Galway, she has a commercial understanding unique to some solicitors and for a time worked in BDM Accountants, Mullingar before entering into her apprenticeship with the well established and respected Hoey and Denning Solicitors, Tullamore where she worked post qualification (2008) before commencing her own practice. Audrey will be the main point of contact for all clients from the outset and prides herself on her open, honest and friendly nature. Audrey has a keen interest in sports, in particular GAA and literature.

Niamh joined the firm in May 2016 having over 20 years’ experience providing legal assistance to leading law firms in Dublin.  Niamh has gained considerable experience in such areas as Commercial and Residential Conveyancing, Company Law, Contract Law, Family Law, Probate and Administration of Estates and Litigation. Niamh holds a Degree in Legal Studies from DIT Aungier Street and has also achieved awards in Human Resources, Training Design and Development, Payroll  - Manual and Computerised Accounts as well as a CELTA Award (Certificate in Teaching English to Speakers of other Languages accredited by University of Cambridge).
