Litigation

What is litigation?
Litigation is a general term which describes disputes that are dealt with by the Courts. Civil Litigation, meaning litigation without a criminal aspect, concerns disputes between individuals or companies which are handled in the civil courts.

Many civil claims are personal injuries claims that are brought as a result of road traffic accidents, accidents at work and slipping or tripping and falling in a shop, on a road or a public place.

You may also have a claim based on breach of contract or an employment dispute. You may have a claim for damages as a result of defamation, where a person’s reputation is injured as a result of the publication by any means, orally or in writing, of untruths about the person.

You may have a claim of ownership in relation to land or a nuisance claim if a neighbour interferes with your property.

The different courts explained

The courts which hear civil litigation cases in Ireland are:

The District Court
has power to award up to €15,000 in damages.
Litigation claims in the District Court are usually brought for minor domestic disputes where the amount of damages (compensation) sought is less than €15,000.

The Circuit Court
has power to award up to €75,000 in damages.
Civil litigation claims in the Circuit Court are usually brought for disputes in contract, personal injury etc where the amount of compensation sought is between €15,000 and €75,000. In certain cases, where the parties to the litigation agree, the Circuit Court can have unlimited monetary jurisdiction. The Circuit Court also deals with some property disputes and most mortgage repossession cases.

The High Court
has unlimited power to award damages.
High Court civil litigation usually involves disputes concerning large sums of money or complex matters. There is no upper limit on awards which can be made in the High Court.

The Supreme Court is only involved in civil litigation cases when an appeal is made to it from a High Court case.
